The services described on this website relate exclusively to the arrangement of development finance for commercial property development projects and do not constitute regulated financial advice. 1. Acceptance of Terms

By accessing and using the London Development Finance website (londondevelopmentfinance.co.uk) and by engaging our development finance brokerage services, you agree to be bound by these Terms of Service (“Terms”). London Development Finance operates as a specialist development finance brokerage. Our services include, but are not limited to, the following:

  • Sourcing and arranging senior development finance, mezzanine finance, bridging loans, stretch senior facilities, and joint venture equity for property development projects across all 33 London boroughs.
  • Providing indicative assessments of development finance requirements based on information provided by prospective borrowers.
  • Introducing prospective borrowers to lending institutions, equity providers, and other funding sources from our panel of established relationships.
  • Assisting with the preparation and submission of finance applications to prospective lenders on behalf of our clients.
  • Providing market information, educational content, and analytical tools (including our development finance calculator) through our website.

Our role is that of an intermediary. We do not lend money directly, hold client funds, provide valuations, or offer legal advice. All lending decisions are made solely by the relevant lending institution in accordance with their own credit assessment processes and lending criteria.

You are responsible for ensuring that you have the legal authority to enter into any finance arrangements on behalf of yourself or your company, and that all necessary corporate authorisations and consents have been obtained. You agree to respond promptly to requests for additional information or documentation from our team or from any lending institution to which we submit an application on your behalf.

5. Fees and Charges

Our brokerage fee structure will be agreed with you in writing before we commence work on your behalf. Our standard fee is a percentage of the loan amount arranged, payable upon successful completion of the funding. The exact fee percentage will be set out in our engagement letter, which must be signed before we proceed with sourcing finance.

In addition to our brokerage fee, you may be liable for third-party costs associated with the finance process, including but not limited to lender arrangement fees, legal fees, valuation fees, monitoring surveyor fees, and any other disbursements required by the lending institution. These third-party costs are not controlled by us and are payable directly to the relevant provider.

There is no charge for initial enquiries, indicative assessments, or the use of the tools and content on our website. Our brokerage fee is only payable in the event that a facility is successfully arranged and completed through our introduction.

6. Limitation of Liability

To the fullest extent permitted by law, Construction Capital Limited, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of this website, our services, or any development finance arrangement introduced through us.

Without limiting the foregoing, we shall not be liable for any losses arising from:

  • Any lender’s decision to decline, withdraw, or vary the terms of a finance application, regardless of the stage at which such decision is made.
  • Any delay in the processing, approval, or drawdown of a finance facility by a lending institution.
  • Any variation between indicative terms communicated by us or displayed on our website and the final terms offered by a lender following full underwriting and due diligence.
  • Any errors or inaccuracies in the output of our development finance calculator or any other tools provided on this website.
  • Any losses arising from your reliance on the information, content, or opinions published on this website or communicated by our team.
  • Any losses resulting from the conduct, performance, or default of any third party, including lending institutions, solicitors, valuers, or contractors.

Our total aggregate liability to you for any claims arising out of or in connection with these Terms or our services shall not exceed the total fees paid by you to us in respect of the relevant transaction.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
